Established Management Board of Nghi Son Economic Zone

Management Board of Nghi Son Economic Zone in Thanh Hoa province is an agency under the People’s Committee of Thanh Hoa province, perform state management functions directly for Nghi Son Economic Zone and industrial zones in the province Thanh Hoa as stipulated in Decree No. 29/2008 / ND-CP dated 14/3/2008, Decree 164/2013 / ND-CP of the Government dated 11.12.2013 and related legislation; managing and implementing service delivery functions of public administration and other support services related to investment activities and production business for investors in Nghi Son Economic Zone and industrial zones province.

Management Board of Nghi Son Economic Zone was decided to establish  by by the Prime Minister and subject to the direction and management of the organization, staffing, program work plans and operational expenditure of PPC; under the direction, guidance and checked on professional of ministries in charge of sectors concerned; shall have to closely coordinate with the specialized agencies of the PPC in the management of Nghi Son Economic Zone and industrial zones in the province.

Economic Zone Management Board Nghi Son have legal status, account, office and a seal bearing the national emblem; funds for state administrative management, operational expenditure and capital investment career development grant from the state budget in accordance with the annual plan.

Duties and authority of Manage Board of Nghi Son Economic Zone

The Management Board of Nghi Son EZ perform the duties and powers stipulated in Article 37, Article 38 of Decree No. 29/2008 / ND-CP dated 14/3/2008 and Article 29 of the Regulation on the operation of the Zone Nghi Son Economic issued with Decision No. 102/2006 / QD-TTg dated 15/5/2006 of the Prime Minister and the duties and powers as follows:

1. Join reviews, construction and the ministries and provincial People’s Committee for approval and implementation of the following tasks

1.1. Join reviews with the ministries, branches and provincial People’s Committee (PPC) in the formulation of legal documents, policies and planning related to investment activities, development of industrial zones and economic zones;

2. The Management Board of Nghi Son economic zone comply with the law and as directed or authorized by the ministries, branches and provincial People’s Committee the following tasks

2.1. Manage, disseminate, guide, inspect, supervise and inspect the implementation of the regulation, planning, planning, investment, land, environment and other fields related to industrial zones province and Nghi Son Economic Zone was authorized State agencies to approve and establish recommendations violation records state agencies competent to sanction administrative violations;
2.2. Investment registration, examination and grant, adjust and revoke investment certificates for projects in Nghi Son Economic Zone and industrial zones in the province under their jurisdiction;
2.3. Granting of certificates of origin of goods manufactured in the industrial park, the Nghi Son economic zone and the licenses and certificates and other relevant certificates in industrial zones, Nghi Son EZ;
2.7. Confirmation of contract documents on property in the industrial park, the Nghi Son Economic Zone for relevant organizations;
2.8. Organizations shall evaluate and approve reports of environmental impact assessments for projects under the jurisdiction of the province in the industrial park, the Nghi Son Economic Zone; confirmed the commitment of the environmental protection investment project in Nghi Son Economic Zone and industrial zones in the province;                                                                                  2.9. Check, inspect and supervise the implementation of the investment objectives specified in the certificate of investment, capital contribution schedule and implementation of investment projects; lead and coordinate examination and inspection of the implementation of the commitments for projects of investment incentives and the observance of the law on construction, labor, wages, social insurance employees, protect the legal rights of workers and employers, the activities of political organizations – social, fire prevention and security – order and protect the environment Status for projects in industrial zones, Nghi Son Economic Zone; decisions of administrative penalties prescribed for violations in the field of competence and propose the State management agencies to handle violations for violations in the areas not under authorization;
2.10. Resolving these difficulties and problems of investors in industrial zones, Nghi Son Economic Zone and recommendations to the Prime Minister, ministries, branches and provincial solve problems beyond their competence;
2.11. Get statistical reports, financial statements of companies operating in the industrial park, the Nghi Son Economic Zone; evaluating the effectiveness of investment in industrial parks, Nghi Son Economic Zone;                                                                                                            2.12. To coordinate with the Ministry of Planning and Investment in building and managing information systems for the Nghi Son economic zone, industrial parks under management;
2.13. Periodic reports to the Ministry of Planning and Investment, the ministries concerned and PPC on the situation: construction and development of industrial parks, Nghi Son Economic Zone; the grant, adjust and revoke investment certificates; deployment and operation of investment projects; perform the obligations to the State; attract and employers; implementation of the provisions of labor law and labor dispute settlement and implementation of measures to protect the ecological environment in the industrial parks and Nghi Son Economic Zone;
2.14. To organize the movement and to reward business operating in Nghi Son Economic Zone and industrial zones in the province;
2.15. Organize and coordinate with the State management agencies in inspection, examination and settlement of complaints and denunciations, prevention and fight against corruption, wastefulness and negative phenomena, and handle administrative violations in Nghi Son Economic Zone and industrial zones in the province;                                                                                                                                     2.16. To perform the duties prescribed by law and the provisions of the PPC on financial management, asset and allocated budget; collect and manage the use of charges and fees; scientific research, application of advanced science and technology; Cooperation with organizations and individuals in the country and abroad in the fields related to the construction and development of industrial parks, the Nghi Son Economic Zone; job placement for workers working in industrial zones and Nghi Son Economic Zone;
2.17. Organizational management, payroll, personnel, public servants and the training and retraining of professional service cadres and civil servants and employees of the management board of Nghi Son economic zone in accordance with law, the PPC.

 3. Develop and submit to PPC for the Prime Minister to decide within its jurisdiction
3.1. General Planning build Nghi Son Economic Zone, plans to expand and adjust the scale and area, conversion of land use purposes were approved in the industrial zone, the functional areas in Nghi Economic Zone Son;
3.2. The issuance plan of project bonds; plans to mobilize other capital sources for investment in development of technical infrastructure and social infrastructure valued Nghi Son Economic Zone;

 4. Building and the ministries and provincial People’s Committee for approval and implementation
4.1. Develop detailed planning of functional areas consistent with overall planning build Nghi Son Economic Zone was approved by the Prime Minister; planning, land use plans detailed in Nghi Son Economic Zone and industrial zones in the province, the provincial People’s Committee for approval and implementation;

5. The Management Board of the Nghi Son EZ directing or implementing the following tasks

5.1. To comply with the law and follow the instructions or authorization of the ministries, branches and provincial People’s Committees are: issuing, amending, revoking business registration certificate under the provisions of the Enterprise Law with the establishment of economic organizations in Nghi Son Economic Zone; level, re-amended and supplemented and extended licenses for establishment representative offices and branches in Nghi Son Economic Zone for foreign tourism enterprises as prescribed by law;

5.2. Hiring foreign consultants perform consulting services for investment promotion, strategic consulting and construction development Nghi Son Economic Zone and industrial zones;

5.3. The investment decision for the project group B, C using the State budget capital investment in Nghi Son Economic Zone and industrial zones in the province;                                                            
5.4. Sign BOT, BTO and BT projects B, C investment in Nghi Son Economic Zone and industrial zones by the Management Board; direct receipt, management and use of ODA;                                            
5.5. Management and use of resources for development investment capital Nghi Son Economic Zone and industrial zones under the jurisdiction of the province; investment management, construction, bidding for investment projects with development investment from the State budget in Nghi Son Economic Zone under their jurisdiction; management and implementation of the revenue and expenditure administration, careers, the program objectives and other capital resources allocated in accordance with the law;        

5.6. Lead and coordinate with relevant agencies implement the renovation and maintenance of buildings of economic infrastructure – social, service buildings and public utility investment budget State in Nghi Son Economic Zone;                                                      

5.7. Management and efficient use of land, water surface has been delivered in accordance with purposes and in accordance with the general planning build Nghi Son Economic Zone, construction detailed planning of functional areas, industrial parks, planning and land-use plan has been approved by the competent authorities. Coordinate with local authorities carry out the compensation, site clearance and resettlement for land, water surface state agencies authorized to recover, assigned to the Management Board to implement the re-allocation or lease of land within its jurisdiction.    5.8. 5.9. On the basis of the provisions of the PPC and the law on investment and land and determine their use fee, rent and rates of exemption, reduction of land and water used for each investment project application in case re-allocation or lease land without auction or tender of land use rights;                  
5.10. Coordination with local authorities and relevant agencies to ensure security and order, fire prevention, fire fighting and all activities in Nghi Son Economic Zone and industrial zones in the province in line with the planning , plans to build and develop the Nghi Son Economic Zone and industrial zones were state agencies competent to approve and relevant regulations; organizational communication, dissemination and ideological education, law officers and local people about the Nghi Son Economic Zone and industrial zones in the province to people to make the support and participation in the construction and development of Nghi Son Economic Zone and industrial zones.

5.11. Decision-allocation and lease of land, water has to be compensated, the clearance at the industrial park, the Nghi Son Economic Zone to people in need in the form of land use land use right auction or bidding for projects involving land use, based on the financial plan and the price was approved by the provincial People’s Committee.
5.12. Price lease agreements, rental construction land with the technical infrastructure, the money using technical infrastructure, service buildings and public facilities in Nghi Son Economic Zone and parks Industrial;
5:13. Organize activities to promote investment, trade, tourism, services, promotions, referrals, negotiation and abroad; implementation of investment consulting for domestic firms and foreign investment in Nghi Son Economic Zone and industrial zones in the province;
5.14. Organizations implementing the decision of the Prime Minister, ministries, branches and provincial People’s Committee for each field in Nghi Son Economic Zone and industrial zones in the province of Thanh Hoa.
5.15. Perform other duties assigned by the Thanh Hoa Provincial People’s Committee in each period.

Industry, sector investment incentives

I. Nghi Son Economic Zone
1. Industrial chemical manufacturers, after refining, the petrochemical subsidiary;

II. INDUSTRIAL PARKS
1. Industrial production of electrical equipment, refrigeration;
2. Investment in manufacturing high-tech products; biotechnology; Electronics and Telecommunication;
3. Investment in the production of medical devices; traditional medicine, western pharmaceutical; plant protection chemicals of biological origin; biofertilizers;
4. Investment in the construction business and industrial park infrastructure;
5. Production of mechanical engineering; industrial parts manufacturing, automobile assembly components;
6. Industrial production of construction materials;
7. The other project was approved the policy of the People’s Committee of Thanh Hoa province;

Investment Incentives Policy

1. The rent and water surface rent: The rent and water surface rent bracket stipulated by the People’s Committee of Thanh Hoa province issued and stable for many years.
The maximum rental period of 70 years, expired on possible extension if investor demand.

2. Exemption from land rent and water surface rent
2.1. Exemption from land rent and water surface rent during construction; free from 11 to 15 years after the project goes into operation, depending on the field of project business lines.
2.2. Exemption from land rent and water surface rent during project implementation for projects in the field of special investment incentives stipulated by the Government.

3. Corporate income tax: Income Applicable to Enterprise from implementing new investment projects.
3 .1. Nghi Son EZ: Apply preferential tax rate of 10% within 15 years, 04-year tax exemption and 50% tax for the next 09 years.
3.2. For investment projects to expand the scale of production, capacity expansion, technological innovation (that meet the criteria prescribed by Decree 218/2013 / ND-CP dated 26/12/2013 stipulating information and guidelines for implementation of the Law on corporate income tax) are selected tax incentives under the project is active for the remaining time (if any), exempt or reduce income tax on the increase due to head Expanding brings. 4. Export Tax and Import Tax

5. Personal Income Tax

6. Other policies
6.1. Policy on prices:
Applying a price policy for goods, services and land rent for investors are institutions and individuals, irrespective of domestic and foreign production activities, trading in Nghi Son Economic Zone .
6.2. Switching losses:
Investors after the tax settlement with the tax authorities that loss shall be carried forward losses to subsequent years; This loss amounts to be deducted from the income subject to corporate income tax under the provisions of the Enterprise Income Tax Law. 6.3. Depreciation:
